AFFORDABLE HOUSING RESTRICTIVE COVENANTS
Ownership of Affordable Housing Units often involves being
subject to promises or obligations related to the housing
unit which are effective not only against the present owner
of the land, but the subsequent owners (e.g. future buyers
of the Unit). These "restrictions" (sometimes called
“Covenants”) often involve conditions of ownership including
that the Unit be owner-occupied or, if it's allowed to be
rented, that the Unit be rented to qualifying tenants at
fixed rental rates and upon established rental terms. They
may also require that the Affordable Housing Unit only be
sold to qualified Buyers at a set resale price and that one
or more state or local agency have the option to purchase
the Unit before it can be sold to anyone else. Many times,
the Restrictions will establish the maximum amount that a
Buyer is allowed to borrower to purchase, or later
refinance, the Affordable Housing Unit.
It is
very important that a Buyer of an Affordable Housing Unit
completely understands all of the Restrictions involved with
the Unit to avoid any unpleasant surprises in the future.
We believe that all Buyers of Affordable Housing Units
should have all documentation related to the Unit reviewed
by a competent attorney.
